User Terms and Conditions
Thank you for using the Authentiq8 Me mobile application for strong customer authentication.
These terms and conditions are a legal and binding agreement between Authentiq8 Me Limited
and you.
This Agreement sets out the terms and conditions under which you may access and use the App and the Services (as defined below). By downloading and installing the App and using the Services, you agree to be bound by the terms and conditions of this Agreement. We recommend that you thoroughly review this Agreement before accessing or starting to use the Services and during your use of the Services. You must not access and use the App and the Services if you don’t agree to all of the terms and provisions of this Agreement.
- Services
During the term of this Agreement Authentiq8 Me shall provide the services to you via the App as set out below,
• The delivery of push notifications regarding authentication requests
• The display of the details for which authentication is required
• The option to provide requested information
• The option to accept or decline an authentication request - License and Restrictions
The Authentiq8 Me App and services are protected by intellectual property rights and laws.
The license grant under this Agreement is not a sale of the Application or any copy thereof and Authentiq8 Me retains all right, title and interest in the Application
Authentiq8 Me hereby grants you a personal, limited, non-exclusive, non-transferable, revocable, non-sublicensable, royalty-free right and license to download and install the App on your mobile device for the sole purpose of enabling you to use and enjoy the benefit of the Services during the term of, and as permitted by, this Agreement.
You agree that you shall not (and will not allow any third party to), either directly or indirectly;
• Share, rent, market, sell, license, sublicense, lease, transfer or distribute, any element of the App and/or the Services;
• reverse engineer, decrypt, decompile, decode, disassemble the App or any part thereof;
• modify, copy, translate, or create derivative works based on, the App;
• remove, breach, override or otherwise circumvent or interfere with any authentication or security mechanisms, or any user limits or other use restrictions that are built into the Services;
• remove or obliterate any copyright, proprietary notices, ownership labels or marks from the App and the Services;
• indulge in any actions with the App and/or Services that will interfere with, destroy, or access in an unlawful way the server networks, connections, systems, records, or other assets, tools or services of Authentiq8 Me or any related third party;
• indulge in any actions with the App and/or the Services that could result in disruption of the Services;
• transmit any worms, viruses, Trojan horses, or any other malware, disruptive or harmful software or data through your access to, and use of, the App and the Services;
• access and use the App, Services or any part thereof for any unlawful or fraudulent purpose or otherwise in any way not permitted by this Agreement. - Your use of the services
3.1. Credentials.
When installing the App on your mobile devices, you will be required to establish an authentication procedure by means of providing your biometric characteristics (a capture of facial image or fingerprint) or, alternatively, a PIN code. You will be required to provide the App Credentials each time you use the App.
You will at all time be in control of the information you provide at the time of authentication.
3.2. Linking to Accounts.
In order to be able to enjoy the Services you will be required to link the App to the Account you are a user of, by scanning a QR code provided online by the Entity that holds that particular membership. Following successful linking to the Entity you can start using the App and the Services in relation to the relevant Account.
3.3. General Requirements.
The App and the Services are available to you through a compatible mobile device and require internet access. You acknowledge and agree that you are solely responsible for the technical requirements relating to your access and use of the Services through your mobile devices, including but not limited to:
Any applicable charges, updates and/or additional fees of your telecommunications provider (internet service provider, mobile service provider and/or other data providers), and using the Services in compliance with the terms of your agreement with your telecommunications provider.
You acknowledge and agree that Authentiq8 Me makes no warranties or representations of any kind, express, statutory or implied, as to whether the telecommunications services from your provider will be available and accessible at any time or from any location. We expressly disclaim any liability or responsibility for any loss, damage or security intrusion, for which your telecommunications services provider is responsible, as well as for any failure of your telecommunications service provider to transmit any data, communications or settings in connection with your use of the Services. You are responsible for the security of your internet connection and the devices you use to access the App and services. - Fees
The provision to you of the services in connection with authentication is provided to you free of charge.
Authentiq8 Me reserves the right to charge fees for additional functionality which may be introduced in the future. Authentiq8 Me will not charge any fees for use of the service without your permission.
You may cease using the service at any time - Changes to this Agreement and Services
Authentiq8 Me reserves the right to change the terms of this Agreement at any time to reflect changes in the Services, applicable laws or regulations, technical, security or business requirements.
Any changes will be notified at least 15 days in advance, except for changes for legal or technical reasons which will become effective immediately on notification. You acknowledge your continued use of these services after that date will constitute your acceptance of those changes.
Authentiq8 Me may at any time update or modify the App, remove functions or add new functionality.
Authentiq8 Me may also perform maintenance of the service from time to time which may result in interruptions for the service.
You acknowledge that your continued use of the Services after any changes constitutes your acceptance of those changes. - Term and Termination
This Agreement becomes effective when you install the App on your mobile device and remains in force until terminated by either party.
This Agreement and the Services may be terminated by Authentiq8 Me at any time with or without notice to you.
Authentiq8 Me reserves the right to disable any Users access to or use of the Services for any reason and without any notice.
When this Agreement expires or terminates Authentiq8 Me shall cease to provide the Service and you shall cease to use the Service. - Warranties
While Authentiq8 Me will endeavour to ensure that the services are available to you at all time, we do not guarantee their continuous, uninterrupted or error free operation and we shall not be liable to you if the services are not available for any reason.
The service is distributed “as is” without any warranties, whether written, oral, statutory, express or implied including as to the fitness for a particular purpose.
We may also temporarily restrict, suspend or deny access to the Services in case of:
• Emergency, Force Majeure, technical problems, system failure or degradation.
• Scheduled or emergency maintenance, or an actual or suspected security incident;
• Suspicious activity, fraud or other illegal actions with respect to the use of App and/or Services by you or attributable by you; or as required by the connected Entity. - Limitation of Liability
To the maximum extent permitted by applicable law Authentiq8 Me shall not be liable for any indirect, special, incidental, punitive or consequential damages in connection with or arising from the Agreement, including but not limited to damages relating to loss of profits, loss of use, delays or business interruptions, loss of business revenue or investment, damage to goodwill, reputation or other intangible losses, however such damages arise and/or whether such damages are claimed in tort, contract or other action, even if Authentiq8 Me has been informed of the possibility of such damages.
In no event shall Authentiq8 Me’s liability for any claim whatsoever exceed £50.00 - Security
You are solely responsible for all activities and actions carried out from your mobile devices via the App using the App Credentials. Any such activities and actions shall be deemed performed by you. You understand and acknowledge that, insofar as you use the App and the Services for the purpose of authenticating yourself towards any connected entity security of your Accounts relies on the safety of your App Credentials. You are solely responsible for maintaining the security of the App and App Credentials against any unauthorised access, use or disclosure.
If you suspect that an unauthorised access to the App has occurred or that the App Credentials have been stolen, compromised or been made known to others, you must change them immediately.
You must immediately notify Authentiq8 Me if you suspect or become aware of an instance of unauthorised access to the App or of any loss, theft or unauthorised use or disclosure of your App Credentials. You should immediately notify the connected entity of the same by means of the communication channels made available to you for such purpose.
Authentiq8 Me reserves the right to deny you access to the Services (or any part thereof) if Authentiq8 Me reasonably believes that any loss, theft, or unauthorised use or disclosure of the foregoing information has occurred. Such denial of access may without limitation enable Authentiq8 Me to investigate said loss, theft or unauthorised use or disclosure (including in cooperation with the law enforcement authorities). - Personal Data and Data Security
Authentiq8 Me understands that your privacy is important to you and that you care about how personal data is collected and used. We will only use your personal data to perform the Services in the App.
Your access to and use of the Service is also subject to your acceptance and compliance with the Privacy Policy of the Company.

You agree to indemnify, defend and hold Authentiq8 Me and its officers, directors, employees, and suppliers harmless from all losses, damages, fines, penalties, costs and expenses (including without limitation reasonable attorney’s fees) incurred or suffered by Authentiq8 Me as a result of:
• your use of the services,
• a breach by you of any of the terms of this agreement or applicable laws,
• your infringement of any intellectual property rights or any other rights of third parties, and/or
• fraud committed or fraudulent misrepresentation made by you. - Laws and Jurisdiction
This Agreement shall be governed by the laws of England and Wales. Any dispute or claim arising out of, or in connection with, this Agreement and its existence, validity or termination (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the courts of England and Wales. - Entire Agreement
This Agreement constitutes the entire agreement and understanding between you and Authentiq8 Me with respect to access to and use of the App and Services and replaces all prior understandings, communications and agreements, whether oral or written, regarding the subject matter hereof. - Severability
If any provision of this Agreement is held to be illegal, invalid, void or unenforceable, in whole or in part, by any court of competent jurisdiction, the remainder of the terms and provisions set forth herein shall remain in full force and effect and shall in no way be affected, impaired or invalidated thereby. Such illegal, invalid, void or unenforceable term or provision or part thereof shall be deemed modified to the extent required to render it enforceable in such jurisdiction, failing which, it shall be severed from this Agreement, which shall continue in full force and effect and be binding upon the parties hereof. The prohibition or unenforceability of a provision of this Agreement in any jurisdiction shall not invalidate such provision in any other jurisdiction. - Complaints
